Program Summary

The Code establishes municipal and non-municipal projects to comply with the Art in Public Places Program. The Code establishes that non-municipal projects with an aggregate project value of one million dollars ($1,000,000.00) or more are subject to a mandatory public art requirement. The following projects are excluded from the requirement:

  • Single-family residences;
  • Projects required to pay a public art fee pursuant to other Miami-Dade County regulations; and
  • Projects at an accredited college or university that maintains a publicly accessible permanent collection of art of at least 30 sculptures or other Public Art on campus in accordance with a Campus Art Master Plan. In order to maintain this status, the following criteria must be satisfied:
  • A Campus Art Master Plan approved by the City Commission; and
  • A report of the Campus Art Master Plan demonstrating changes to the campus  collection of Public Art must be submitted to the City Commission every 3rd year.

All eligible projects must contribute an amount no less than one percent (1%) of the project value and may satisfy the requirement in the following ways:

  • Installation of on-site artwork and Donations are recommended by the Cultural Development Board and subject to approval by the City Commission;
  • Donation of artwork to the city, subject to approval by the Cultural Development Board;
  • Combination of on-site artwork installation and contribution to the Art Acquisition Fund;
  • Facilitation of the purchase, designation, restoration, or perpetual maintenance of historically significant buildings or parcels identified in the City’s Parks and Open Space Inventory Analysis; or
  • Purchase, donation, and installation of artwork may be proposed in-lieu of payment to the Art Fund.
