Program Summary

The Code establishes that all new development projects, including parking structures, residential developments of four (4) units or more, and commercial and industrial development projects with a building valuation or valuations exceeding two hundred fifty thousand dollars ($250,000) in the aggregate, shall be subject to the mandatory public art requirement.

The public art requirement may be satisfied by paying one percent (1%) of total project valuation of the development project excluding land acquisition and off-site improvement costs, not to exceed four hundred fifty thousand dollars ($450,000), for an art fee; donate approved art work which shall have a minimum value of one percent (1%) of the value of the proposed project development, not to exceed four hundred fifty thousand dollars ($450,000), in lieu of the fee; place on the property on which the development project is located, approved art work which shall have a minimum value of one percent (1%) of the value of the proposed project development, not to exceed four hundred fifty thousand dollars ($450,000), in lieu of the fee; or a combination of these options subject to the approval of the city council.
