Program Summary
The Code establishes that the following projects are subject to a mandatory public art requirement:
- New residential development projects of ten (10) or more units;
- New commercial, industrial, and institutional development with a building valuation of seven hundred and fifty thousand dollars ($750,000.00) or more;
- Tenant improvements, exterior remodeling, and additions with project valuations of seven hundred and fifty thousand dollars ($750,000.00) or more for existing industrial, commercial, institutional, and residential properties with ten (10) or more units; and
- Infrastructure improvements (including telecommunications, natural resource development, and delivery systems) valued at three million dol- lars ($3,000,000.00) or more.
Projects may satisfy the requirement by including an approved public artwork with a minimum value of one percent (1%) of the total building valuation on-site. Alternatively, developers may contribute an in‐lieu fee equal to one percent (1%) of the total building valuation to the Public Art Fund. The fee must be paid before a building permit is issued.
