The requirements are as follows:
- For-profit development projects with construction costs exceeding one million dollars ($1,000,000.00) shall allocate an amount no less than one percent(1%) of the construction budget, but no more than two hundred thousand dollars ($200,000.00) for public art; and
- Non-profit development projects with construction costs exceeding one million dollars ($1,000,000.00) shall allocate an amount no less than half of a percent (0.5%), but no more than one hundred thousand dollars ($100,000.00) for public art.
This requirement may be satisfied in the following ways:
- Acquisition and installation of a public artwork on the development site; or
- Contribution of the required amount to the City Public Art Fund.
When the developer chooses to acquire and install a public artwork rather than simply contribute to the fund, the developer must deposit the required allocation into the City Public Art Fund, and the fund will administer the contribution as well as pay artists and fabricators directly for any such artwork.
