Program Summary
The Code establishes that buildings with a floor area of thirty thousand (30,000) square feet or more, the alteration or repair of fifty percent (50%) or more of the floor area of such building, or any building that is part of the development of a subdivision of forty (40) or more lots are subject to a mandatory public art requirement. The construction, repair, or alteration of buildings to carry out publicly assisted rehabilitation of private property, low or moderate income multi-unit housing projects, and the construction, repair, or alteration of improvements that are not buildings are excluded from the requirement.
Projects may satisfy the requirement by including a work of public art on-site, the value of which shall be a minimum of one percent (1%) of the building valuation, subject to approval from the Art in Public Places Committee. Alternatively, developers may pay an in-lieu fee to the Art in Public Places Fund, the value of which shall be one and one quarter of a percent (1.25%) of the building valuation.
