Program Summary

The Code establishes that all new residential development of more than four (4) units; all commercial, industrial and public development projects, with a building valuation exceeding fifty thousand dollars ($50,000.00); and all remodeling of existing residential buildings of more than four (4) units, commercial, industrial and public buildings when such remodeling has a valuation exceeding fifty thousand dollars ($50,000.00) (exclud- ing earthquake rehabilitation required for seismic safety) are subject to a mandatory public art requirement. Buildings which are designed and dedicated to performing arts spaces or museum uses are excluded from the requirement. The value of a residential unit covenanted for very low, low, and moderate-income households or for senior citizens shall not be included when determining the value of a residential development.

Projects may satisfy the requirement in one of the following ways:

  • Provide on-site artwork with a value of one percent (1%) of the total building valuation. Maintenance and conservation of the artwork will be the responsibility of the property owner;

  • Contribute an in-lieu fee of one percent (1%) of the total building valuation to the City Art Fund;

  • Posting of financial security in an amount equal to the acquisition and installation cost of an approved artwork in a form approved by the City Attorney; or

  • Donation to the City Council of an approved artwork.
