Program Summary
The Policy establishes that developments with a total building valuation of one and a half million dollars ($1,500,000.00) are subject to a mandatory public art requirement. The following projects are excluded from the requirement:

Places of worship;

Residential development projects of four (4) or fewer dwellings; and

Public facilities constructed by 501(c)(3) nonprofit organizations or affordable housing projects are issued an exemption on a case by case basis.
Projects with a valuation between one and a half million dollars ($1,500,000.00) and less than four million dollars ($4,000,000.00) may satisfy the requirement by contributing one percent (1%) of the construction valuation to Brea’s Art Fund or installing a sculpture of the same value. Projects with a valuation of four million dollars ($4,000,000.00) or more must install a sculpture, approved by the City, with a value of one percent (1%) of the construction valuation. Maintenance and conservation of the artwork will be the responsibility of the property owners. The Cultural Arts Commission or its designee shall inspect each sculpture for damage or maintenance concerns.
