Program Summary

The Code establishes that commercial, industrial, and residential developments; remodeling and modification with a building permit valuation of two hundred and fifty thousand dollars ($250,000.00) or greater; and new single-family tract construction on five (5) or more lots or new subdivisions of five (5) or more lots are subject to a mandatory public art requirement. The following projects are excluded from the requirement:

  • Individually built single family homes;
  • Reconstruction of a building built prior to September 23, 1997, if destroyed by fire, earthquake, or flood and rebuilt to the same size and height;
  • Rehabilitation of a building or structure listed on a local, state, or national historic register; and
  • Construction or modification of existing developments for an educational institution, residential development, or other organization exempt from federal income tax under IRC
  • 501(c)(3).

Projects may satisfy the requirement by installing on-site public art. Maintenance and conservation of the art will be the responsibility of the project applicant or their successor. Alternatively, developers may pay an in-lieu fee to the Public Art Fund, or a combination of on-site art and a fee, subject to the approval of the City Manager or designee. The minimum value of the art or contribution shall be:

  • Commercial and industrial developments: one percent (1%) of the total building permit valuation;
  • Residential developments: half of one percent (0.5%) of the total building permit valuation;
  • New single-family tract construction or subdivisions: half of one percent (0.5%) of the total building permit valuation; or
  • If the minimum allocation for the development project is twenty thousand dollars ($20,000.00) or greater, then an amount equal to ten percent (10%) of the minimum allocation shall be deposited into the Public Art Fund and the balance of the allocation shall be used for on-site artwork.
