Program Summary
The Code establishes that all private developments with development costs of two hundred and fifty thousand dollars ($250,000.00) or more are subject to a mandatory public art requirement. Residential projects of five (5) or fewer units, regardless of development costs, are excluded from the requirement. Developers voluntarily participating in the program shall follow the program’s procedures.
Projects may satisfy the requirement by installing a work of public art on-site with a value equal to one percent (1%) of the development costs, with a maximum value of one hundred and fifty thousand dollars ($150,000.00). The artwork must be visible from a public right-of-way or other public property and must be installed prior to the issuance of a certificate of occupancy. Maintenance and conservation of the artwork is the responsibility of the property owner. Title to all works shall pass to the successive owners of the development, who shall be responsible for the custody, protection, and maintenance. Alternatively, developers may pay an in-lieu fee to the public art fund equal to one percent (1%) of the development costs, with a maximum contribution of one hundred and fifty thousand dollars ($150,000.00). The fee must be paid to the Building Division at the time development costs are due.
