Program Summary

The Code establishes that all new buildings or structures and alteration or repair of an existing building or structure within the DSP, IMU, IMU-R, SFMU, C1, C2, C3, CR, MS, CPD, CH, and CA zones with an improvement valuation of five hundred thousand dollars ($500,000.00) or more are subject to a mandatory public art requirement. The following projects are excluded from the requirement:

  • Projects financed with public funds or development in-lieu fees;

  • Small and/or affordable residential buildings and structures of up to two (2) units;

  • Designated historic resources;

  • Nonprofit service providers; and

  • Vehicle dealerships.

Projects may satisfy the requirement by providing on-site art, subject to approval from the design review authority upon recommendation of the Arts and Culture Commission. The value of the art must be at least two percent (2%) of the project valuation and shall be installed before issuance of final certificate of occupancy. Maintenance and conservation of the artwork will be the responsibility of the owner of the site. If the artwork is altered, removed, is not maintained in good condition, or is not provided as required, the city may exercise administrative remedies. If administrative remedies do not result in proper maintenance, the city may impose a fine equal to the value of the urban artwork. Alternatively, developers may pay an in-lieu fee of one percent (1%) of the project valuation into the Urban Art Fund.
