Program Summary

The Code establishes that commercial, industrial, office, other non-residential, and residential development projects with five (5) or more dwelling units with a project cost greater than one million dollars ($1,000,000.00) are subject to a mandatory public art requirement.

Projects may satisfy the requirement by installing an artwork onsite or donating an artwork to the city. The value of the artwork shall be one percent (1%) of the project cost. If the value of the artwork is less than one percent (1%) of the project cost, then the difference shall be paid to the city and deposited in the Art in Public Places Fund and/or in the Library Improvement Fund. Maintenance and conservation of the artwork is the responsibility of the property owner.

Alternatively, developers may pay an in-lieu fee of one percent (1%) of the project cost to the Art in Public Places Fund. At the option of the de- veloper, fifty percent (50%) of said fee may be deposited in the Library Improvement Fund, which shall be utilized to acquire, construct, or make capital improvements to the Monrovia public library facilities. Subject to a disposition and development agreement with the Monrovia Redevelopment Agency, the development may construct on-site improvements to satisfy the requirement.
