Program Summary
The Code establishes that new residential projects of ten (10) or more residential lots in a subdivision or dwelling units; new nonresidential projects, commercial, office, or industrial, with project costs of five hundred thousand dollars ($500,000.00) or more; expansion or remodel of existing nonresidential projects with project costs of two hundred and fifty thousand dollars ($250,000.00) or more; and mixed-use projects consisting of both residential and nonresidential development that either have ten (10) or more residential lots or dwelling units or have a project cost of two hundred and fifty thousand dollars ($250,000.00) or more are subject to a mandatory public art requirement. Affordable and senior citizen housing; civic and cultural facilities; and reconstruction or repair for damage by fire, flood, wind, earthquake, acts of terrorism, or other calamity are excluded from the requirement.
Projects may satisfy the requirement by installing artwork in a publicly accessible place on the project site or in the vicinity subject to approval by the public arts commission. Maintenance and conservation of the artwork will be the responsibility of the owner. Alternatively, developers may contribute an in-lieu fee to the Art in Public Places Fund. The value of the art or contribution shall be:
- Residential projects: half a percent (0.5%) of the total project costs, excluding land; or
- Nonresidential projects: one percent (1%) of the total project costs, excluding land.
