Program Summary
The Code establishes that all new residential development of more than five (5) units; and all commercial, industrial, and public building development projects, with a building valuation exceeding five hundred thousand dollars ($500,000.00); and remodeling projects with a valuation exceeding two hundred and fifty thousand dollars ($250,000.00) are subject to a mandatory public art requirement. Low or moderate income housing, senior housing, performing arts facilities, museums, public buildings, interior remodel or tenant improvements, and repairs pursuant to natural disaster or code requirements are excluded from the requirement.
Projects may satisfy the requirement in one of the following ways:
- Contribute one percent (1%) of the building valuation to the Art in Public Places Fund;
- Donate an approved artwork, equal to or exceeding the value of one percent (1%) of the building valuation;
- Install an approved artwork, equal to or exceeding the value of one percent (1%) of the building valuation. Maintenance and conservation of the artwork is the responsibility of the site owner. The developer must record a covenant on the subject property which provides for ongoing maintenance of approved artwork prior to certificate of occupancy; or
- Design the development in such a manner that it qualifies as “Architecture as Art,” pursuant to Section 23.81.140 of the Ordinance.
