Reconstruction of structures which have been damaged by fire, flood, wind, earthquake, or other calamity; and religious, hospital, scientific, charitable organizations, public educational institutions constructed on property exempt from taxation pursuant to California Revenue and Taxation Code Section 214, are excluded from the requirement.
Projects may satisfy the requirement by installing artwork in a public place on or in the vicinity of the project site as approved by the City Council. The value shall equal or exceed one percent (1%) of the total project cost. Alternatively, developers may pay an in-lieu fee equal to one percent (1%) of the total project cost to the Art in Public Places Fund.
