Program Summary

The Code establishes that all commercial and industrial development projects where the project cost exceeds two hundred and fifty thousand dollars ($250,000.00); and residential projects of more than two (2) lots or units, including single family residential structures, condominiums, apartments, townhouses or other dwelling units, where the project cost exceeds five hundred thousand dollars ($500,000.00) are subject to a mandatory public art requirement. Projects that consist solely of the reconstruction of structures damaged by fire, flood, wind, earthquake, or other calamity; projects constructed on property exempt from taxation pursuant to California Revenue and Taxation Code §214; and single and multi-family residential remodeling projects are excluded from the requirement.

Projects may satisfy the requirement by acquiring and installing original creations of art in a public place on-site or in the vicinity of the site, as approved by the City Council, the cost of which shall be equal to or greater than one percent (1%) of the project cost. Maintenance and con- servation of the artwork that remains on the project will be the responsibility of the property owner. Alternatively, developers may pay an in-lieu contribution to the Public Arts Fund, the value of which shall be equal to one percent (1%) of the project cost.
