Program Summary

The Code establishes that private development projects are subject to a mandatory public art requirement:

  • Non-residential and non-live-work building developments with costs of more than three hundred thousand dollars ($300,000.00) are subject to design review approval by the Emeryville Planning Commission; and

  • Live-work building developments of twenty (20) or more units are subject to design review approval.

Projects may satisfy the requirement by acquiring and installing public artwork on-site, the value of which shall be at least one percent (1%) of development costs for private non-residential and non-live-work developments, or at least half of a percent (0.5%) of development costs for private residential and live-work developments. Alternatively, developers may pay an in-lieu fee in the amounts as calculated above to the Emeryville Public Art Fund for acquisition and placement of public art throughout the City.
