Program Summary

The Code establishes that commercial or industrial developments with total project costs in excess of one hundred thousand dollars ($100,000.00) and residential developments, including single-family homes, having a total project cost in excess of one hundred thousand dollars ($100,000.00) are subject to a mandatory public art requirement. The following projects are excluded from the requirement:

  • All public work and governmental agency projects;
  • Reconstruction of structures which have been damaged by fire, flood, wind, earthquake, or other calamity; and
  • Religious, hospital, scientific, or charitable organizations if the project is constructed on property exempt from taxation pursuant to California Revenue and Taxation Code.

Projects subject to the ordinance shall contribute by including an artwork in a public place on or in the vicinity of the project site, subject to approval by at least three-fifths (60%) of the city council. The cost or value of such artwork shall not be less than one and a half percent (1.5%). In the event that the value or cost of the artwork falls short of the required value, the applicant shall pay the difference to the Art in Public Places Fund. Maintenance and conservation of the artwork is the responsibility of the property owner. The building permit shall not be issued until the city council has approved the application, and the certificate of occupancy shall not be issued until the approved work of art has been installed unless otherwise agreed.

Alternatively, developers may satisfy the requirement by paying an in-lieu fee to the Art in Public Places Fund equal to one and a half percent (1.5%) of the total project cost, unless otherwise provided by the city council. Building permits shall not be issued until such contribution has been paid.
