Program Summary
The Code establishes that new commercial developments (including office, retail, industrial, or light industrial uses) that have a gross floor area of fifty thousand (50,000) square feet or more and any commercial portions of new mixed-use developments are subject to a mandatory public art requirement. Exceptions to this requirement can be found in the code referenced above.
Projects may satisfy the requirement by providing publicly visible art on-site with a value of at least one percent (1%) of the construction valuation. If less than the required fee is spent on public art, the balance shall be contributed to the Art in Public Places Fund. Maintenance and conservation of the artwork is the responsibility of the property owners. Developers must file a public art permit application with the Director of Parks, Recreation, and Community Services prior to issuance of any building permit. The artwork must be installed prior to the issuance of a certificate of occupancy.
Alternatively, developers may satisfy the requirement by contributing an in-lieu amount equal to one percent (1%) of the building valuation. The in-lieu fee is to be used to fund art in public places. The in-lieu fee shall be paid prior to issuance of a building permit for the project.
