Program Summary
The Code establishes that new commercial (including office and retail), industrial, light industrial uses; mixed use (nonresidential portion only) developments; new tenant improvements in a shell building; and additions to, rehabilitation, renovation, remodeling or improvement of an existing building where construction costs are at least two hundred and fifty thousand dollars ($250,000.00) are subject to a mandatory public art requirement. Exceptions to this requirement can be found in the code referenced above.
Projects may satisfy the requirement by installing art in a public place on-site or in a public place nearby with a value equal to at least one percent (1%) of the construction cost or by installing public art with a value less than the required value and contributing the balance to the city. Maintenance and conservation of the artwork will be the responsibility of the site owner.
Alternatively, developers may pay a contribution to the city equal to one percent (1%) of the construction cost. Projects which provide a significant benefit to the public where the required fee would exceed five hundred thousand dollars ($500,000.00) may request that their fee be capped at five hundred thousand dollars ($500,000.00), if the developer submits evidence and documentation that payment in excess of that would be prohibitively expensive for project delivery.
